Dear All, Please help me. One of our employee misuses of cash and fraud some local purchase items last one month back. At the time Management give to final warning letter. At present our factory manager change and he knows his above incident and he says terminate him services. Please send letter of termination at the time. Raju

dear raju once you have taken decision to issue him fianl warning letter than how you will terminate him now for one offence you willl punish him twice. dear you can not terminate someone services without giving him opportunity to explain himself as per principle of natural justice.if things movesz in court than only management understands the law. you follow law of the land and terminate. tks j s malik

You cannot terminate an employee like this.. firstly if you feel an employee has done something wrong u need to issue him a show cause notice and if you are not satisfied with the reply you need to make a propery inquiry into it by forming a bench who would look into the case... findings of the bench inquiry would lead to termination of services stating that you were found guilty of the offence and hence as per the company manual clause so and so your services are hereby terminated with immediate effect. But in this case since you have already given him the final warning and no inquiry has been conducted you cannot terminate his service at your own sweet will after lapse of certain time duration......Its Illegal and he can prove in the labour court that intially he was left of with warning and now again company has taken action for the same case which was over some time back......

Dear Raju, It is our function to both ensure that the employee does not misuse the organisation and the organisation does not misuse the employee. Once the organisation has already participated in a disciplinary act, that same event cannot be used by a later/newer executive as a source of prejudice against the employee. You would need to advise the manager in this fashion

Follow a proces. Ask the Manager to document the entire thing in case history. As a final warning was given. Based on the Manager's documentation and evidence in what ever possible way it can be received, give the employee a show cause notice for explaning his act in 48 hours. (Hope the problem has happened a couple of days back). In case the reply is not received from the employee in 48 hours, you can terminate his services with immediate effect.
