dear all , please advise me what are the options available to the employees, if a Pvt,Ltd. company in Delhi does not pay salary for a long time,& can engineers and Managers sue the company in the Labour court ?

Yes, of course. collect the proof such as previous salary slip, Bank Statment, A.O. etc.,, and approach the Labour office neaby. Regards, SIDMAN

No. managers are come under the purview of labour court. They are not workmen by the definition given in The Indsutrial Disput Act 1947. They can go the civil court agaisnt the employer. anupam

The defenation is correct given b y you, By approaching the Local authorities, they will guide you better regarding the proceeding and the method for going further, Simply you cannot hire a advocate and fight,
When Manager's are facing problem than how come the people under them are safe, going to labour authority will dig it deep and get benefits to all the workers that is why you have to approach the Local Labour body first. This itself will create fear in the employer and will come down immediately with alternative and solutions.

If the Managers are not paid salary or if there had occurred any illtreatment against service conditions they can raise it as a breach of contract in a civil court though they can not find any recourse in Labour Court.

Dear
As per the recent amendment to the ID Act the ceiling has been increased to Rs10,000/-.The legal distinction between "supervisory " and workmen is a very thin line.
In case you send a legal notice the Employer may pay up.You can consider that option before venturing into any litigation.

Dear Animesh,
Yes managers are kept out of the definition of WORKMEN, but it is really considered if they are getting salary below 10000/-they shall be treated as workmen by new amendment as stated by VS Rajan, or otherwise they have to proceed for civil suit; which takes lot of time.other option is speed court.

Dear
It is not speed court but Fast Track Courts where cases are decided on a fast track basis.The entire expenditure for these Courts are borne by the Central Govt though managed by the State.

Fast Track Courts are already there in every State and functioning smoothly.What you are saying is Special Courts which is meant for a special purpose.Fast Track Courts are regular Courts which dispose cases on a Fast Track basis.
