Hi all,

I worked with a Indian IT major, my employment was on contract for first 9 months and later they made me permanent 3 months ago in Jan. I was not very happy with my profile and package and in between got an offer from some other company who wanted me to join in 15 days.

I put the resignation in the tool(online) stating that I have got offer from some other company who are paying me better and also told them (verbally) that I have some financial issues in family hence need this job anyhow and will not be able serve 2 months notice. i also told them in writing that I am willing to pay notice pay. My manager gave no concern to it and said that he cannot relieve me until I serve 2 months notice (nor he can increase my salary or change my role in the team) and I will have to give KT to the replacement. I kept requesting them for 2 weeks(post resignation) but they did not considered my request , hence I left the company ( told my reporting manager on phone) and submitted the laptop (took receipt also from IT dept) and joined the other company.

My new employer knows the entire scenario.

After one week of joining I got a call from HR (of previous co) stating that they will send me a legal notice as I have not given proper KT and will run an absconding action against me which means that i will not get the relieving letter and experience letter and Full and final settlement will also be not done.

I want to know what can be the implications or consequences of this legal notice , can they send it to me even after I have stated that I am ready to pay the notice pay amount and I have also submitted the laptop.

Pls suggest ...

I am submitting the most practical solution which neither you nor the members of this forum would not even have dream about it.
I suggest your previous employer(still he haven't relieved you as per company norms) to take legal action against your current employer who tempted you to join his organisation..
At this moment, you need Good Luck....

1)You would'nt hv informed that your lvng the job bcoz your not happy & also abt package in your company.
2)Should not leave the company with out resignation accept.
3)May be your new company has accepted, but you need experience letter for your future.
Solution:
Pls contact your Xcompany HR & Your Reporting Manager, please request them, no other go
Take a printout of your resignation E-letter and get it signed as accepted...( be in pleasing manner)....wht ever they tell you, say ok, ensure you will get your Relieving letter & experience letter, itz very imp.........
Nothing is impossible..........
Henceforth never do such mistakes.

Hi.. thanks for your views .. I have the exp letter of contract till jan but will not have it from Feb till april ( when i was made permanent).. I will not show this experience in my resume .
I told them that i am not happy with the work as i dont see any growth in it and also that my pkg is less and am not able to sustain expenses as my family is dependent on me for everything. But my manager said that he cant release me as he do not have any replacement.
i want to know can they sue me for not serving the notice period ... I am ready to pay the amount i am liable for and i have also submitted the laptop issued to me..
I have already joined the new company and cannot go back to them.. pls suggest..

OK, if you have relieving letter exp upto Jan'11 its good.
Xemployer may take legal action or black listed, dont worry because as per Mr skhadirskhadir's you have not relieved.
I would like to know wht exactly you mentioned the reason for your resignation???
If you mentioned as personal reason, pls get medical certificate that your not wel, and keep it wiith you.
If you mentioned as other reason- You need good luck maa..........

the reason mentioned was 'better compensation and better job profile' . they are aware of where I am working now due to some common links.
I wanted to be true to them and hence did not lie of being not well. i went there for 2 weeks and completed the necessary KT but still my manager was not satisfied .
if they send me a notice and I pay them the notice pay, can some other action be taken by them?? I have already submitted the company laptop and taken taken recipt.
what else company can demand in legal notice apart from notice pay and company property ?
