Eligibility for Salary When Probationary Employee Resigns Without Notice

I understand the situation like this: an employee on probation resigns and, without serving the notice period, leaves the company. Will he be eligible for the salary for the days he has worked?

The answer is yes. He can claim the salary for the days he has worked. However, if there is a specific notice period mentioned in the appointment order and it is enforceable by law, then the employer will have the freedom to adjust it against the notice pay receivable from the employee who left.

Leave Entitlement for Employees on Probation

No employee shall be refused leave on the grounds of their nature of appointment. Therefore, if they are eligible for leave, it should be granted to them even if they are on probation.

Accrual and Encashment of Earned Leave

Earned leave will be accrued after working for at least 12 months. If an employee remains on probation and wishes to encash their leave upon leaving the organization, they may do so.
