We are planning to work on August 15, which is a national holiday. We come under the Factories Act. The question is how many times the wages need to be paid or if any compensatory holiday needs to be provided for that day. Currently, we are paying festival wages and a one-time salary. Is that correct, or do we need to pay two times the salary in addition to festival wages? Kindly clarify the valid legal points.

National Holiday Compensation
As per settled law, three paid national holidays are compulsorily admissible. For making someone work on a national holiday, one would be entitled to payment at the rate double of the daily wages and Compensatory Off, which should be given within 90 days of the national holiday or holiday for which the employee has worked.

Please go through the Karnataka State Industrial Establishments (National and Festival Holidays) Act, 1963, which is applicable to your factory.
As per Section 5 of the Act, the compliance is as follows:
a) The employer can allow the employee to avail the holiday with wages on that holiday OR
b) Require him to work with twice the wages OR allow him to avail a substituted holiday with wages.
"Twice the wages" means one day's wages in addition to the normal wages for that day.
