Hi, and thank you for all your time reading the post. I want to ask, I have decided to leave my current job. I am still under the probation period. I am giving my employer 1 week of notice as per my contract and award. I believe the employer can't stop employees from resigning. However, I am the only one who has received "specific" training to provide "specific" services offered by the company. I am worried if the employer will sue me for ruining their business, as when I go, more than likely they will have to train another person so that they can provide the "specific" services.

Terms and conditions of the offer letter would have to be checked. If they have spent money on training you and there is a minimum period you have to serve, then the company can ask you to pay back the cost of training. Unless one specifically knows what is there in your job contract, a clear answer will be difficult. The company may not accept your resignation without recovering the cost of training.

Thank you above, yes you are right there is training incentive I have to pay them. And I have every intention to pay them that amount. Then can they still sue me?

If you pay the amounts due why shoyld they spend time and money suing you. They will train a replacement and move on. Deal tactfully
