Dear Seniors,

I need clarity on the topic of the "Annual Report on Sexual Harassment Law." Recently, we learned that every private limited firm is required to file an annual report related to sexual harassment law. Is this mandatory? If yes, what will be the format of this report? What will be the procedure, and do we need to submit this in compliance with the annual reports?

Filing Annual Reports under the Provisions of SHWW (P, P & R) Act 2013

Filing Annual Reports under the provisions of the SHWW (P, P & R) Act 2013 is mandatory; failing which penalties are prescribed. The Annual Report filing is as follows:

Under Section 21 of the said Act of 2013, the Annual Report for the calendar year is to be prepared by the Internal Committee and filed before the District Office notified under Section 5 of the said Act.

A copy of the IC Annual Report for each calendar year is to be forwarded to the Employer/Head of Establishment, who, in turn, shall incorporate the data/details in the Annual Report of the Company to be filed before the ROC.

The headings for the AR are provided in Rule 14 of the SHWW (P, P & R) Rules 2013, gazetted on December 9, 2013.

Every employer of every workplace in the organized sector with ten or more workers at the workplace is required to constitute the Internal Committee.
