Dear All, I have joined a pharmaceutical company one month ago. This company was established in April 2018 and is an LLP (a division of one of the group of companies), with a team of 24 people, including medical representatives and others. There are 20 medical representatives. Our office is only in Mumbai, and the MRs work from their current locations (where they stay) outside of Mumbai, operating from home.
Obtaining a Shop & Establishment Certificate
Now, we want to obtain a Shop & Establishment Certificate. I would like to know how many employees I should mention on the certificate, as we are more than 20 and are also applying for PF and ESIC. Additionally, PT was deducted last month.

Shop and Establishment License in Mumbai
A shop and establishment license is no longer required in Mumbai for any office with fewer than 10 employees (however, I don’t have the notification copy). So, if you have only 4 employees in the office, you don’t need a certificate.
Professional Tax in Maharashtra
You should also not be deducting professional tax in Maharashtra for employees who are not in the state of Maharashtra. You are instead liable to pay it in the relevant state. Practically, however, it’s difficult to register for PT in a state where you do not have an office. In any case, there is no PT liability in Maharashtra for any person not working in the state.
