Dear Sir,

Is there any provision to pay extra wages to Daily Wage employees for 26th January, 15th August, and 2nd October? Can anyone provide a circular for the same? If any employee attends the office on any of these days, are they eligible for extra wages, double wages, or leave? Please guide.

Employment Regulations During National and Festival Holidays

Please note, no employment is allowed or permitted during National Holidays unless you are exempted as a continuous process industry and have approval for the same.

Employment on Festival Holidays

Employment of permanent, contract, or casual employees on Festival Holidays (The National Festival Act) requires prior permission from the Inspectorate for maintenance in continuous process industries. In such cases, you must pay double the wages, plus one holiday with wages.

There is a small exemption/exclusion clause in the Act for any casual or contract workmen employed on Festival Holidays. These employees are eligible for one day leave with wages, provided they are on the company's rolls or have worked in the preceding 30 days.

You are advised to follow the rules of the state, either under the Shops & Commercial Establishment Act or the Factories Act, where your establishment exists. In the absence of certified Standing Orders or Leave rules of the establishment, it is to be noted that no employment is allowed or permitted during National Holidays. You have to pay double the wages or provide a substituted holiday, or pay double the wages with a substituted holiday, or triple the wages, as the case may be, as per the rules of the state.

I am working in Tamil Nadu. Can anyone help with the provision which requires triple wages to be paid.
