Immediate Job Departure and Salary Deduction Issue

I completed 15 months in one organization as a system engineer and felt the need to leave the job due to some issues with my company. I was working for a client company, which was very nice, but the problem lay with my own company. I informed the branch manager of my client company that I was leaving for a new opportunity in another organization with immediate joining availability. He had no issue with my decision, and I left the job last Saturday. I also informed my company about my departure on Wednesday.

I mentioned to them that it was not possible for me to serve a 45-day notice period. Consequently, my reporting manager informed me that he would terminate my employment, which was acceptable to me as I did not require a relieving letter. On the same day, Wednesday, my salary was credited to my savings account in SBI. However, today, after two days, the entire salary amount was debited from my account because I had not served the notice period.

What should I do? Any ideas or suggestions I could consider?

Hi,

I see you are from Thane, so under the Bombay Shops and Establishment Act that applies to all of Maharashtra, they have to pay you wages. However, they can still file a civil suit under the Contract Act as you breached the contract. They cannot, however, deny you your right to wages under the pretense of a notice period violation. You can approach your area's Labour Inspector and lodge a complaint.

Hii, Thanx for the suggestion but my company is in Chennai and client company is in Thane Mumbai so is it possible to log a complaint against them frm Mumbai????

Thank you once again for the details. My organization's branch is in Mumbai, but I am reporting to the Chennai office. Is it possible to log a complaint under the Tamil Nadu Shops and Establishment Act from Mumbai, or do I need to visit there? If it is possible from Mumbai, could you please suggest the steps to do so?
