I received a notice from my previous company regarding full and final settlement. I worked there for only 20 days, during which I experienced significant harassment, leading me to resign. Initially, I did not submit a resignation letter, but within a week, I emailed HR about my decision to resign. Instead of serving the 15 days' notice period, I proposed that they buy out the notice period from my 20 days' salary. My expected salary for 30 days was 20,000, and they quoted a buyout charge of 7,000 for 15 days. However, in the notice, they claimed that I am liable for only 4,000 and should pay them 11,000. Please advise me on how to respond as I do not wish to pay them unnecessarily.

Appointment Order and Exit Terms

Did the company give you an appointment order? What were the terms governing the exit? While you could have submitted your resignation promptly, you have not collected your pay for 20 days of work. The company should not be pursuing you for the 15-day notice period, or it could be to set an example for other employees that they should take the notice period seriously. I do not think that you have to pay them anything. Write a simple letter and explain your point of view, and then do not worry about this company. However, you need to follow the terms of the exit properly to avoid unnecessary trouble.

Can you put the notice for people to read on the forum(some details can be masked)?? Is it notice signed by HR or their advocate?? You can consider discussing matter with your legal advisor also.

Dear Friend,

You can ask for buyback calculations via email and request an explanation for the calculations. What is the notice period that you need to serve? What happens if the notice period is not served?

I have not read the Exit Policy of your firm but can share how it generally works. The notice can never be adjusted against the amount to be disbursed by the company. Notice Period and salary are not calculated on the same metrics. If your per day salary in a month is calculated on your CTC, the Notice Period might be calculated on your basic. Hence, the amounts vary marginally. Once you have resigned, your salary will be calculated in your Full and Final Settlement, which will include pending leaves and every other calculation. Keeping every calculation in view, you are unlikely to deduce it accurately unless you know the formula they use.

Furthermore, they have asked you to pay before releasing the amount because that's exactly how it works. Unless you clear the accounts from your side, they can't initiate F&F. I echo Nath Rao, please pay the amount to avoid any friction. Wish you all the best!
