does managers in pharma sector come under labour law can they fight for salary holded by office in labour court in india.if to manager 5 people reporting to him.his salary is below18000/ pm.

Hi,
What is his role? In any company, if the person falls in the defination of workmen under ID act can raise the dispute? Secondly, if he does not fall under workmen defination, in Pharma, for saleperson, there is a Act, under which he can raise the dispute.

Dear Sanju,
I do agree with Mr. Sanju. If he doesnot fall under Sec. 2(s) of the ID act, he cannot raise any dispute in the labour court. He can aise the civil dispute for the same.
Pl. let me know what are the tasks he is handling? Any subordinates are working under him? Has he got managerial powers such appraisal, leave sanctioning, recommending for promotion of his subordinates, alloction of work etc. If he has such powers then he cannot termed under Sec. 2(s) of the ID Act.

their is one line in annexure in appontment letter
10. liasion with head office as regards the recuuitment of field staff.
11. responsible for monitoring the field staff for their acheivement of sales targets and better productivity by objective appraisal of their performance.
is the above is part of employee can be said as supervisory role hence he canot file a case in labour court?.pls guide
