I want to know that we are a factory manufacturing auto components. We observe Sunday as the weekly off. Can we call some of our employees on Sunday as a normal working day and give them staggered off? We are a unionized factory, and for more than 25 years, we have been giving Sunday as the weekly off to all our employees working in the factory. If we change their weekly off and give them staggered off, will it be legally correct and covered under which section of the Factories Act, 1948?

There is no issue in calling any worker on Sunday (weekly off) based on work requirements. The union has no right to interfere in this matter because it is the duty of the management representative to assign work as per the production schedule. However, the weekly off should be given to workers within the 10th day, i.e., no worker should go without a weekly off for more than 10 days, as per the Factories Act, 1948.

The suggestion given by Mr. Mahew is partly correct. You have to inform the change in the weekly off day to the Factory Inspector and get his approval and permission. If you have a union in your factory, have an agreement with the union to implement the change if the change is of a permanent nature.
