Dear sir,

I am working as a Shift Engineer. Recently, my weekly holiday has been changed from Sunday to Wednesday effective from 1/1/2016. I had availed my last weekly holiday on 27/12/2015 (Sunday), and my upcoming week holiday will be on 6/1/2015 (Wednesday). Therefore, I will only avail of 2 weekly holidays between three consecutive weeks, i.e., from 28/12/2015 to 13/1/2016 (I have worked for 18 days).

My question is, am I eligible for 3 weekly holidays in this case?

Thank you.

As per the Factories Act, the company can offer you a weekly day off without extending continuous working for more than 10 days.

In your case, the change in days doesn't exceed the continuous working limit of 10 days. If you receive fewer weekly offs this month, you will have more Wednesdays off in the next month, so there is no need to worry about that.

You will have the first week off on the 6th, which is after 10 days, in compliance with the policy. Following that, you will also have days off on the 13th, 20th, and 27th. Therefore, there is no violation of any rules.

You are right. But I'm also eligible for one week off for 6 working days. I'm getting only 1 week off for continuous 10 days. And week off on dated 6/1/2016 is for the current week, so what about last week's week off i.e. from 28/12/2015 to 2/1/2016?

Can you give me suggestions for Thailand, please?

You have availed a weekly off on 27th December, and afterwards, your weekly off was changed from Sunday to Wednesday starting from 1st January onwards. Hence, you will have only two weekly offs from 28.12.2015 to 13.01.2016. As per the Factories Act, you should not work more than 10 days without a weekly off. Therefore, you do not need to consult the HR department regarding this issue.
