Hi friends, I am an advocate based in Delhi and usually deal with matters relating to IPR and company laws. Recently, one of my clients has requested me to handle compliance in Labour law. They are esteemed builders in India and are seeking compliance. I request your help in understanding what needs to be done, especially in relation to the CLA and BOCW Act 1996. What are the key considerations when engaging with them for work? I would be immensely grateful if you could assist me with this matter.

A Construction Company Showing Special Attention Towards Statutory Compliance

Usually, in our country, the majority of construction companies do not follow statutory compliance. This includes regulations for contract workers, the Building and Other Construction Workers Act, the Inter-State Migrant Workers Act, the Workmen's Compensation Act, and environmental pollution-related laws like those for water, ground, sound, and other kinds of pollution occurring due to construction activities at specific locations. Permissions from various government bodies (labor boards, Forest Department) and local government bodies are often overlooked. Instead of obtaining permissions and paying taxes, they are managing with alternative accounts. Even senior people heading the HR and admin teams are not focusing on training HR and site admin personnel in statutory compliance. They are advising on tricks, smart games, and how to manage with money, spending lavishly on training. 

Please send me a detailed email about what you would like to know regarding the statutory compliance of a construction firm.
