As per Section 31 of the IT Act, every employer is bound to issue a TDS certificate in Form 16 to employees if any tax has been paid to the central government on behalf of the employee.

As far as legal options are concerned, first, you should send a pleader's notice to your ex-employer for the recovery of the dues. Wait for their official reply. I am sure they will respond to the pleader's notice. If you don't receive any reply from them, then the last option is filing a case against them in civil court. However, try to avoid reaching this last option.
