Dear Seniors, my friend was working for an organization that has not provided Form 16 to any employees to date. He quit the organization due to the bad financial condition and the non-payment of salaries for more than 5 months. Now, my friend has been informed by the finance manager that the company has not deposited the tax deducted from the employees and, therefore, will not be providing Form 16.

What should he do now? Please suggest.

Thanks,

Kavitha

Advise your friend to write a letter to the company and keep a record of it. Send at least 2-3 reminders. Then, he has to deposit the tax liability along with interest if applicable, and submit his return to the income tax department.

Afterward, he needs to write a letter stating the references of the earlier letters, along with a copy of the return and the Challan of Tax Payment. In this letter, he should demand the amount of TDS deducted but not deposited, along with interest, and include a copy of the IT department correspondence.

Thank you.
