We are a limited company with six board directors. We have recently included a deputy managing director as part of our board. Do we need to inform the Inspector of Factories about this change? If so, what are the formalities involved, and which forms should be used?
Thanks,

Dear Senthil D.,
Under section 7(4) of The Factories Act, 1948, we are required to send intimation to the concerned CIF on the appointment of a new factory manager as per the procedure laid down in the applicable Factory Rules. We are also required to apply for an amendment in the Factory Licence if there happens to be any change in the particulars of the licence, for example, a change of occupier, etc. However, we have not seen any provision which states that we are required to send any intimation to the CIF or Inspector of Factories when there is a change in the list of directors.
Opinion/comment submitted as requested.
