Hi Siba,

Please find the details one by one.

1. Leave Rules (EL, CL, etc)

As per the Factories Act 1948, the employer has to provide leave (by whatever name) to the employees. An employee can take one leave for every twenty working days of the previous year, which amounts to 15 days, provided they have worked for a period of 240 days or more in a factory during the preceding calendar year. Now, let me explain how.

There are a total of 365 days in a year. If we deduct 52 days of weekly offs and 8 paid holidays, only 300 days remain. When we divide 300 by 20, we get 15 days, which is the minimum required as per the Factories Act.

2. Overtime (Pay Calculation in %)

According to the Factories Act, if a worker works in a factory for more than nine hours in any day or for more than forty-eight hours in any week, they shall be entitled to wages at the rate of twice their ordinary rate of wages for overtime work. It's important to note that bonuses will not be included in the calculation of wages.

3. Permission (Rules)

To work overtime, the employer must seek approval from the chief inspector as per Section 54 of the Factories Act.
