My wife has been working as an Assistant Manager (IT) in a private limited company for the last three years. Although the establishment is covered under ESI, my wife is not a beneficiary of ESI. Will she get maternity benefits as per the Indian Maternity Benefit Act, 1961?

Dear Mr. R.N. Khola,
I am working with a PSU as an Executive Officer, and I have a query.
The PSU recruitment process, as you know, is normally lengthy. I had applied for the exam in August 2008, appeared for the exam in November 2008. The results came out in December 2008, and the interview was held in January 2009. The final result of my success came in April 2009. By that time, I was 7.5 months pregnant. I was supposed to join for training in Pune in May 2009, for which I duly joined and completed the three weeks training. Subsequently, I had joined at my place of posting for one day and got my maternity leave sanctioned for six months. I was blessed with a baby girl (which is my second child) on 22nd June 2009. I was given the salary due to me for these six months and thereafter joined back after my leave on 30th November 2009. My probation period was extended by the time equivalent to my leave, i.e., six months. My query is, will this extension of my probation result in losing my seniority as well by the same time? My organization is saying so, but I doubt as that is against the spirit of the Maternity Benefit Act. Please advise on the course of action that should be taken by me.
