Hi,

I would like to ask, does the employer have the right to ask the employee to show them the new company offer letter?

1) The current company wants me to stay, but they are not offering what the other company offered to me. Yet they still need me to show the offer letter to them. Do they have the right to do so?

2) May I know who is the final decision-maker to revise the employee's salary? Is it the Vice President of the division, HR Executive, or Country Manager?

Hi,

No employer has the right to ask for the offer letter of a new employer. I believe that it is not advisable to show it to them. If they are offering satisfactory pay, then you can continue with the current employer itself.

Actually, the salaries will be fixed by the HR manager. That is the procedure. However, in some organizations, it varies. Moreover, it depends on the organization.

Current employers have no right to ask for the new employer's offer letter. If you are comfortable with your current employer and intend to stay with them, provided that they offer a salary on par with the new employer, you may choose to show it to them. If you demand a position hike, you will receive a salary increase.

Hi there,

No employer has the right to ask the employee to show his offer letter; that is not considered good HR practice. It is at the discretion of the employee to disclose the name of his new employer. Your reporting manager would suggest the percentage of the hike to be given to you to your HR manager, who in turn would implement it.

Thanks for your reply. I think you're right; it is a decision for me.

One more question: who will actually decide the last working date of resigned staff? Does it involve HR? Since in my division's practice, they don't care how many annual leave you have, they will only void your annual leave.

Dear LI,

I have a different opinion. The final salary is fixed by the unit head or CEO, and the HR manager has the right to express his/her views regarding salary revision/raise. Showing the offer letter to the present company is like a suicide. Additionally, the present employer has no right or privilege to ask for or see the offer letter. If you are not interested in continuing with the present company, please submit your resignation and work until the notice period is over (as per the contractual agreement through the appointment order) or pay the notice pay and bid farewell to all.

Hello Li,

Firstly, I would like to state that if you have decided to move, do it gracefully. The current employer has no right to ask for your offer letter. In case you happen to show them and they offer you a competent salary compared to what you have received from the new company, it's not the right practice. Does it mean that your value in the company was nil until you got an offer letter from a new company? So, I suggest not getting into this mess at all. In fact, we still witness this kind of unhealthy practice even today!

Regarding deciding the salary, it rests with the team manager and division head primarily, while the role of the HR would be to give them enough options by providing the parity chart.

Dear Li,

I have read all the replies too. I fully agree with the views expressed. I would even go one step further - if the current employer 'asks' for the 'offer letter', you should leave immediately. It is not a good HR orientation at all. Every organization needs to trust its employees. And a good HR should know the market value of the employees.

Your immediate boss should be vested with the authority to fix your date of leaving - but HR would have a lot of say in that. The Division Head will be the one normally deciding if there are special issues like relieving early, notice period pay waiver, leave adjustment, etc.

Hi,

If they are asking for an offer letter to show, then show it to them. After all, what more could they do? They will just see it, and what then? Tell them another company is offering me more, and I want to leave this one. So please proceed further and relieve me. Be straightforward.

Every activity regarding employees of the company will be handled only by the HR department. Obviously, the last date of your service with the company will be decided by HR in accordance with the service agreement.
