I want to know if an employee goes on leave the day before a festival holiday and returns two days after the holiday, can the festival holiday be legally deducted? Please advise as per the Act.

First, decide under which Act you are providing this holiday. In my opinion, festival holiday provisions are present in the following two laws:
1. State Industrial Establishment (National & Festival Holidays & Casual & Sick Leaves) Act.
2. State Shops & Commercial Establishment Act.
Therefore, first decide the applicability of the Act and then go through the provisions relating to eligibility and the grant of Festival Holidays for your unit.
