if the company has incorporated in 2007 but the comany yet to starts it business. is the bombayshops & Estb. Act applicable to the said compay

Dear,
You may go through the definition of the shop and commercial establishment under The Bombay Shops Act. According to the definitions, unless any trade, business, etc., is not there on any premises, then it will not be considered under the definition of a shop or establishment. Unless the premises are not covered under the definition, the Act will not be applicable. The Act is applicable to Shops & CE, and if you are not covered under the definition, then how will this Act become applicable.
