Hello to everyone,

I need a help.

In Dec-14 I joined a Ltd. company. It is a Sugar factory in U.P. on getting verbal offer from the Unit Head and Dept Head and after facing an interview I joined the company. Both of them promised me to take me on permanent roll in company. After joining I inquired so many times about my joining formalities and permanent/joining letter etc. but they always give excuses like MD is out of country or Joining procedure takes long time in this company etc. After three months they stated me that company is not ready to take you on permanent roll but may work on contract basis. As I don't have any choice that time so I had to work on contract basis but when I asked about my contract copy they also didn't provide it. I continued to work and time to time I asked about my contract letter and they replied it will be received soon.

Above story is the basic information now I come to the point-:

In the middle of March-16 due to some emergency (my son aged 10 months was hospitalized) I had to go to my home so I gave a Leave Application of 9 days against my Compensatory Leaves (work done on Sundays / Holidays) pending to my reporting officer / Head of the Department. He sanctioned the leaves and kept the application with himself saying that he will get sanction from Unit Head also and sent it to Time Office. As there is an emergency I left to my home. In the period of leaves I was continuously in connection with my HOD / Reporting Officer and giving feedback of situation. But when I came back to my office, The Unit Head (newly appointed) , called me and told me to hand over my charge to my subordinate and dismissed me from my duties without mentioning my fault and also didn't approve my leaves and said that I will discuss it with your HOD then approve it.

In the past I had taken advance of Rs.20,000. Before leaving the factory Account deptt. asked me to adjust salary against advance and I said Okay to them as I have done 11 days working in M/o March and 9 days compensatory leaves pending so total 21 days salary to be prepared which will be around Rs.21000 approx as my CTC was 3.90 lacs approx.

But now they are sending me Notice of outstanding balance of Rs. 9800 approx in my name. They have not sanctioned my CPL and only 11 days salary has been prepared approx Rs.11500/-

I have replied via email to adjust my outstanding after adjusting my CPL but they denied. My HOD/Reporting Officer that time also resigned from there to whom I had given my Leave Application. Now they are warning me to take Legal action. In this condition what should I do or What action I can take. I have worked there for 16 months continuously but they neither gave me any appointment letter/joining formalities nor contract letter and terminated me from my duties without any notice and mentioning any fault.

Kindly guide me what should I do.
