Hi Team,
I got the UAN a/c got created by my previous employer almost 2 years ago i.e. around March 2014. I left the organization in Sep 2014. While creating UAN a/c my DOB is entered wrongly by my finance team. I noticed it lately after some time on October 2014. I have informed the same to my previous employer and even after follow-ups, There is no action taken from their side. The issue still remains.

With my new employer, they opened a new PF a/c and after some time, they started merging all PF a/c with UAN a/c for all the employees, They failed to do it as the personal information on the UAN portal (DOB) is matching with the new PF a/c opened by my current employer.

With my previous employer, I filled up the forms, gave screen shots of the UAN passbook, copies of my PAN card and Aadhar card as proofs, But no action has been taken from their side, which resulted in a loss of interest amounts to Rs. 42000 for the F.Y. 2015-16

What are my rights to sue the previous company against my loss, How to proceed with that?

First take up the matter with EPF authorities about less interest being credited with working sheet.
Or is it a case due to DOB problem your PF contribution was not deposited?
At any rate,suing for loss of interest can be done only when all other efforts fail,including getting in touch with EPF authority.
Whether you will only end up spending lawyer fee or get interest is yet another question.

Write an email to Director of the company, if the HR/Account Managers are not responding to your query. Even if director is also not responding, the visit PF office and meet RPFC to resolve the issue. sueing the company is like waste of time and energy .
Utilise your valuable/precious time for the current organisation.

Its not only your problem dear, I am the HR in my company and I found this problem with so many employees,
Mismatch of DOB is just the error showing while putting previous employer details. It can be any error like your father's name is different or may b your name. Let me give example
If somebody's name on Voter Id is jashankumar pareshlal bhut and on other photo ID it cud be Jashbhai Pareshbhai bhut.
In that case both names are different for Pf office and it shows DOB mismatch error.
So I request you to check all your documents whether all your name is same or not.
Or your leaving date of previous organization may be put wrongly in system.
In all this case it will show DOB missmatch error
In that case now you can mail them on uan helpdesk or online uan complain.

What an employee can do if his /her employer is reluctant to rectify his /her DOB as well as spelling of name. This employee is pursuing the matter for last eight years but without any result. As and when the employee raising the issue with HR, the manager used to send a reminder to the consultant to take necessary action and wash off his hands. This employee is continuing the service with the same company and that is why he was not able to do any thing on his behalf but now the employee is about to leave the company in one month time and plans to transfer his PF to the new Co. he is worried about his PF. Kindly suggest what he should do.
