Thanks for the Gazette of the ESI, but sir already we are deducting the new 21 k wages from Nov 2016 month and paid the same in Dec 2016 what about that contribution will it be applicable or not before the Gazette publised date mentioned plzzz inform and thanks for your immediate response

Since the effect of increase in contribution is wef 1.1.2017, you can claim rebate/adjustment on the amount you paid extra for nov.2016 paid in dec.16. wishes

If some one drawing within Rs 21000/- doesnt want to be a part of this ESIC scheme and give a letter in writing regarding that, can we exclude the employee from paying ESIC ?

If paid excess contribution in the month of Nov 2016 paid in Dec 2016 can be adjusted in Dec 2016 contribution payable in Jan 2017.

Hello Everyone,
Need a better clarification on ESIC deduction, as ESIC is deducted in gross salary of 21000/- what if the company pays amount in incentive monthly.
Eg- "X" salary details for Nov'16 is Basic- 6500, HRA- 3000, Special All-425, Conveyance-1600,Other allowance- 5474, Incentive-9750 (which is not fixed vary on sales target achieved ).
Kindly advice the ESIC deduction???
And also please clarify is the ESIC amount vary monthly depending on Incentive amount.

Dear Richa,
Basic, HRA and conveyance would definitely attact in count for gross salary. dSpecial allowance, other allowance and incentive is under question for accountibility for counting gross wages.
As per esi law, any amount paid after a gap of two or more months, won't attact counting in wage ceiling of 15000/- or 21000/-(from dec/16).
But this question arises for the starting months of contribution periods i.e. april or october. Rest all month deduction will b made if gross wages exceeds the wage limit till end of contribution period.
