In our organization all the female employees who are covered under esi are getting the maternity benefits.Can anyone kindly assist me with any scheme or way by whch we can provide maternity benefits to those who are not covered under the act

Hello Rohit,

For females who are not covered under ESIC act are covered under Maternity Act.

The crux of the act is -

If a female has worked for atleast 80 days (continuous service) then the female becomes eligible for claiming maternity benefits.

As per the act, the female is eligible to have a paid leave of 12 weeks.

Ideally the 12 weeks is 6 weeks prior to delivery and 6 weeks post delivery; however firms allow the females to adjust the 12 weeks so that she can spend it most after delivery.

In addition to this 12 weeks paid maternity leave, the female is eligible for 1 month's additional paid leave if there are complications and illness arising out of her pregnancy.

After all such leaves are exhausted, the employer may grant leave without pay if the female is unfit to resume her work.

The employer is not to terminate the female's employment due to her pregnancy.
