If an employee working as a driver on JCB with an LMV licence and that loader operation closed 6 months ago. Without any notice to the labour union and labour department can hr terminate an employee from the job?

Am i right in presuming that loading operation was closed 6 months back and the JCB driver was terminated? Pl indicate the length of service of the JCB Driver. Notice of the termination order has not to be given the union or labour department unless the driver is a protected workman as per the ID Act 1947. .
HR normally does not terminate services of the employee, HR only communicates the decision taken by the authority concerned. If the employee is working in HR Department, then HR official can decide it provided he is authorised by the rules of the establishment to appoint a person as JCB driver.
