अगर कोई कंपलेंट written मे दी गई है और उस पर 4 गवाहों के साइन भी है तो क्या written कंपलेंट के आधार पर HR हमे वॉर्निंग लेटर दे सकता है क्या? ओर अगर हम लेने से मना कर दे तो मेरे खिलाफ आगे क्या एक्शन हो सकता है ?क्रप्या मेरा मार्गदर्शन करें।

Issue of warning letter is a punishment. HR has to comply with the process laid down under Industrial employment Standing orders Act or the process laid down in the Certified Standing Orders of the Company.
Before issuing warning the HR has to follow principles of natural justice.

HR might have done the preliminary inquiry about the misconduct, might have obtained inputs from the eye witnesses, Security ,obtained inputs from your immediate superior / HOD and gone through your previous track record and concluded that you are involved in that particular incident.

As the misconduct is not serious then they have issued warning, suggesting you not to involve in such incidents / not to repeat such incidents, warning letter is almost an advise.

If you have any concern on the same you can submit your comments with reference to the warning letter so that the HR can organize the Domestic inquiry.

As it is not a capital punishment, in general HR is authorized to issue a warning letter. Even in most of the companies HR is authorized to issue capital punishment letters also.

If you refuse to receive the warning letter then there is every possibility of issuing charge sheet, Suspension pending inquiry, Organizing Domestic inquiry, then suitable punishment.
