Hi,
This is in reference to the gratuity amount which is eligible to an employee who has completed 5 yrs of continuous service. I'm going to complete 5 yrs this April, while I'm also looking for a change in job. My concern is whether the notice period be included in the period of 5 yrs of service. We have a 3 months notice period in our organization.

Dear Sender Yes — the notice period for which the employee has worked , will be considered as part of his service while computing his gratuity payment. Regards L.Kumar

When the employee resigned and completed 4 years of service and part of the fifth year, in fifth year it will be claculated basing on the number of days worked. If he/she has completed 240 days he/she is eligible to get the grautity.
