can anybody pl advise me for the below mentioned
our company has been depositing the employees pf amount of 12% on the basic salary which was above the limits beyond the basic salary of Rs 6500 ( eg if somebody basic salary was Rs 12,000/- than 12% on Rs 12000/- both employers and employees contribution deposted with the pf authority)
this practice was followed for very long time
now some lawyer have instructed the management to restrict the contribution of both the employees and employers should be reduce to the basic salary amounting to Rs 6500/-
can the management now reduce the contribution
if so, than what are the remedies available for both the management and the employees
pl advise

Hi,
Please reply this letter with photocopy of letter under which you was given 30 days and challan under which you have deposited dues mentioned the facts in the letter.
Hope it will be settled becuase now-a-days this exercise is being done through computer. Computer can not reconised the details of letter it will simply check due date and date of deposited.
As regards "Applied for challans" since last two month SBI, SEC -2 NOIDA is not accepting the challans with code "applied For".

Dear Anuradha,

Please take the notice seriously, first they must have mentioned the date of representation in front of the Deputy Commissioner or officer. Please meet on schedule date. You will have to pay the interest & damages as there are no way to reduce it. In case of firm were pf is applicable by law immediately the payment in the challan with application form has to be made. Since you had rightly applied but made the payment lated ineterst has been charged. It cannot not be possible the you company did not received earlier intimation or notice from PF office. PF office follows steps of racovery and send all the notices for recoveries to the employer. Similar case has happened with my company but we had received earlier initmation which our pf consultant had not informed. We had to pay interest and damages or pf offices immediately issues non cogniglible warrent against the employer.

So do not waste time in suggestion make the payment and show to the PF authorities.

Dear Alex in your firm case you cannot reduce the pf deduction from 12% on 10000/-, you can frige to that amount, next any new employee joins limit to 6500/-. It is against the law to reduce deduction from higher basic to law basic. Be careful. The reduction is possible but it has to be appleaded in PF office and reason are to be given, only in specail cases it is allowed. otherwise you cannot reduce.

Dear,
Mr. Vasudeo,
The date for payment of P.F. contribution is 15th day of the following month. There is a grace period of 5 days in some special condition.
Annual return of P.F. has to be submitted with the concerend PF office up to 30th April for the last financial year. (For P.F. Contibution purpose financial year is March to Feb.)
RPFC stand for Regional Provident Fund Commissioner
APFC Stand for Assistant Provident Fund Commissioner.

I want to know that if Pf contrbution is not submitted till 15 date what wiil be given after 15. how many penalty charges will be paid by an employer after 15 . plz tell me this by days accordingly.
