EASE OF MAINTAINING REGISTERS UNDER LABOUR ACTS.

Sub: New Co-Off & Leave Register Form E.

This is with reg.to the Govt. Notification that the Regrs.(shown below) are subsumed, merged for ease of maintaining different Regrs.under various Labr.Laws.

Form A. . Format of Employee Register
Form B. . . . Format of Wage Register
Form C . . . Format of Register of Loan/ Recoveries
Form D. . . Format of Attendance Register
Form E . . Format of Register of Rest / Leave / Leave Wages

In this regard, the following points may be considered.
The Govt. has subsumed; merged together some LL Regrs. under Mines Act, PWA, MW, FA, etc., “New FORM E” is prescribed for Co-off and Leave. This will require P&A Mgrs. to maintain both Co-off and Leave account together in one Regr.E as against 2 (Two) separate Regrs. being maintained now.(dtls. 1 & 2 below). The P&A Mgr.must keep Extra-work Regr. in each Dept. & ensue that those who work on Holidays alone claim Co-off. If no Regr., there will be mis-use & no accountability to GM/MD,FI,LC,DDMS etc.,
This can cause administrative problems for P&A Mgrs. since the Regrs. for the two issues i.e.
1. Extra work done & Co-off availed and
2. Leave Earned, Availed & balance in cr. etc.
are two separate issues and now maintained separately as per F.A., Mines Act- details given below.
1 a. COMPENSATORY OFF RULE – F.A.
As per FA., Sec.52:- where a worker has worked on Sundays or Holidays, he is given Co-off within the next 2 months. Most P&A Mgrs.HODs keep one Regr. to show Extra work done & Co-off availed and this is checked, accepted by Auditors, Inspectors since this Regr.helps P&A Mgrs. to check & verify when/what/why the worker performed extra work; who approved it and when he took Co-off against that; i.e., the HR Mgr. is able to check the Regr. & ensure that the worker has worked on some Sundays & he is availing Co-off against that.
1 b. LEAVE RULES - F.A.
As per Sec.79; the Leave earned, availed and balance leaves are maintained in Leave Regr. i.e., 2 separate Regrs.are kept
1 Regr. for Extra work done & Co-off availed and
1 Regr. for Leave Earned, Availed & balance etc.
This system of maintaining separate Regrs. facilitates checking & controlling extra work and helps P&A Mgrs. to administer the above two works/issues without any problem.

2 a. CO-OFF RULES – MINES ACT
As per MA.,Sec.29:- when a worker has worked on Sundays or Holidays, he is given Co-off within the next 2 months. Most HODs, P&A Mgrs. keep one Regr. to show Extra work done & Co-off availed and this is checked, accepted by Auditors, inspectors since this Regr.helps to check & verify when/what/why the worker performed extra work; who approved it and when he took Co-off against that.
2 b.LEAVE RULES - Mines.Act.
The MA prescribes Leave Regr. to show the Leave earned, availed and balance leaves in cr. & it is maintained in separate Leave Regr. i.e.,
2 separate Regrs. are kept
1 Regr. for Extra work done & Co-off availed &
1 Regr. for Leave Earned, Availed& balance in cr. etc.
Thus; the 2 separate Regrs. facilitates the leave admn. of the employees under MA.

In this connection, I request Sr.Members kindly to inform whether the Govt. merging of the Regr.E. will cause administrative problems for P&A Mgrs. to maintain them.
Form E Regr. has been prescribed to furnish C-off, Leave etc., This can cause problems since clubbing Co-off & Leave earned, availed etc., will lead to problems to Regulate, administer Extra work -Co-off and Leave which are two separate & important works of P&A Dept. It will also confuse Mandays account for Statutory Returns; since Mandays should include all worked days BUT exclude all Leave, absent days etc.
The Extra work done a/c.(for which Co-off will be availed later) is NOT to be included in the Leave a/c. so that Mgmnt get clear picture of total No.of days Extra work done and Co-off availed & it is verifiable.
The Leave a/c. has to be separate since there will be CL, SL, PL. LWOP, OH/RH, MB, etc.to be maintained & shown; to get a clear and realistic account of all Leave details of all employees for MIS., Statu.Returns etc.,
I hope the above is useful. You are requested to correct; if there is error in maintaining Regr.& what is to be followed. Please share the procedures you follow to maintain Statutory Regrs. for Extra work - Co-off and for Leave Account vis-a-vis Register E prescribed by the Govt.
Every P&A Mgr. must have all Imp. P&A. Acts, Systems, Rules, Forms to administer P&A. works properly; as P&A Mgr. is answerable to
F.I., L.I., PFI, Pension, ESI, Gratuity, PT, other Govt. Officers, Auditors, HODs, GM/MD, Employees etc., and he has to solve all employees problems; keep Records in Per. Files for future reference DURING THE LIFE OF EMPLOYEES & COMPANY ITSELF.
