Hi everyone
Probation in my company is six months. However one of the employee's probation was not confirmed after this period nor performance assessment done.However after 13 months her probation was not confirmed and it was extended by another six months indicating that she did not perform satisfactory.
The employee had previously indicated challenges to her supervisor.
What are your views in this? And how can this be addressed. is unfair labour practice or victimisation or both?
Please advise.

Hi,
She already worked for 13 months after completion of 240 days she will be a permanent employee how her probation can be extended after 13 months.
This is victimization only. If she is ready then let her refer her case to the labour department or challenge in the court of law.
First of all let the employee represent the case to the HR and senior managers in the organization, even after that justice is not done then she can approach external people because the senior officials may say afterwards that you would have approached us as we are not aware of the same.

you can not extend pronation as per your choice .these points are cleared in standing orders.however she becomes permanent after completion of 240 working days.
let her be silent and work there.no use of talking to labour dept.
