HI IAM A FRESHER IAM HR EXEC AND I WORK WITH A ITES PVT LTD COMPANY WHICH IS A SERVICE PROVIDER TO USA BASED CLIENTS. COMPANY HEAD BRANCH IS SITUATED IN INDIA GUJARAT REGISTERED IN INDIA
PROBLEM- THEY DONT ALLOW NATIONAL HOLIDAY
THERE ARE NO HOLIDAYS ON 26TH JAN, 15TH AUG, OCT 2ND OR DURING DIWALI COMPANY FOLLOWS HOLIDAY AS PER USA FEDERAL HOLIDAY LIST AND WHEN ANY EMPLOYEE DOESNT SHOW UP ON INDIAN HOLIDAYS THEY DEDUCT 2 DAYS SALARY FROM THE PAY CHECQUE DUE TO WHICH EVERY MONTH LOT OF GUYS LEAVE JOB
PLS LET ME KNOW ARE THEY RIGHT OR IF WRONG THEN WHAT COULD BE THE SOLUTION
HOW WILL EXPLAIN THE EMPLOYERS THAT THIS IS NOT A RIGHT PRACTICE

This is a grossly wrong policy. under Shops and Establishment Act you need to give holiday on the National Holidays. Also deducting this 2 days salary is violation of this act. So you can go to your area labor inspector and lodge a complaint.

As per the Shop & Establishment Act, It is mandatory to give holiday on National holidays and failure to do so carry a Fine. In case the employee is required to work on national holidays the employer is required to pay double the wages.
