I have a small query regarding employee relieving, i.e., next Wednesday (25-Apr-2016). In my organization, one employee has received a student visa for Canada, and now he is asking to leave the organization within two days without completing the two months' notice period. Can you please help me with the procedure for the exit? How can we draft the relieving documents, or should we give him a normal relieving letter? His code of conduct and behavior was good, and he worked for the company for 1.5 years. Please share the procedure and documentation part for this query.

It depends on the terms and conditions of employment. If your company policy permits either a 2-month notice period or 2 months' gross pay in lieu of notice, then you can consider proper relieving after deducting 2 months' pay from his settlement or by collecting a separate demand draft. It's basically at the discretion of the employer. If the employer is okay with one month's pay, then you can consider that option as well. Another alternative is to relieve him with a relieving order stating that the notice period was not served. So, you have multiple options. Consider whether his immediate relief would result in a loss of work production or if his presence is needed until a replacement is found, based on his role within the company.
