I am working in a PVT LTD Company on 5/june/2014 company HR terminate me without given any notice and warning. after that she asking me please put up your resignation then after we process your salary 9/june/2014 I have resigned my job but still am not getting my may month salary. nobody can pick up my phone calls and not answering my messages. am facing financial problem due to this issue.
please you all suggest me right what can I do.

Dear Kulbeer Singh,
First kindly confirm, whether your Date of joining is correct..? its mentioned as June 2014, it means few days back..?
yes, then why they have terminated you very soon...?
This case can be viewed in two ways..
1) if they terminated you then why did you put your resignation..? not its case shall be treated as resignation as i believe you must have not any written communication about termination from company.
2) termination can be happen in probation without notice or with notice too. its purely depend on terms & conditions are mentioned in your employment letter.

My date of joining is 2.sep.2013 and she will be terminate me on 6/june/2014 and I have put down my resigned on 9/june/2014 after telephonic conversation. i have my termination letter. she said that your approach to work is slow thats why we terminate you and after 2 day she said we need your resignation for salary process.

Dear Kulbeer,
Kindly approach the higher authorities to know about the situation. Normally the company may take a months time to process the full and final salaries.
Still the companies needs to keep you in loop for the same. Did you also take a acknowledgement of the resignation letter that was submitted by you? This will help you in the long run.

Mr.Kulbeer Singh,
Before joining to your company, they must have given appointment order or offer letter. Whether they have mentioned the clause of termination either side during probationer y period and after confirmation. If you are in probationary period and then your services are terminated by serving termination notice in writing, then your HR no right to seek your resignation. Either you have to resign on your own or termination from employer either one but not both. Please share your problem clearly to enable you to advice by experts in this thread.

Dear Kulbeer,
First Try to find out why she is asking for resignation even after termination.
As you said your joining date was 2-sept-2013 and she terminated you on 6-june-2014 i.e. more than 6 months. Kindly tell us whats was your probation period? are you a confirmed employee or still on probationary period.?
There might be some clauses in appointment letter or offer letter about Termination policy after confirmation and during probation period.
I guess if she asking for your resignation b/c there may be some clauses in appointment letter which was not in favor of company in case of termination from companies side. * like "After confirmation, your services are terminable without assigning any reason, by giving one month’s notice in writing or salary in lieu, thereof on both side."
Please again go through your appointment letter and make clear all this things and tell us, that will help us to understand your problem more easily

Many of my friends advised definately help you but you have not raise your querry with clear facts .
To understand your issue properly, please send me scan copy of the following documents on my mail ID
1. copy of your appointment letter
2. copy of your termination letter
3. copy of your resignation letter
4 any other documents related to your service terms and condition.
After study of the above documents. I will give you appropriate suggestion for your problem/issue.

Hi kulbeer,
Good day... thanks for all your valuable advices.. I have a very similar one...
I recently joined a company in mumbai as store manager, I worked with many international brands in retail, since in this company I found they are little weak operationally. . But as per them I am slow in work... not only that some amt was short in our so they deduct from my salary which I haven't recvd yet.... my salary is keep on getting delayed.. yesterday thr was a manual global count in store.. it was not audit or stocktake... but in manual count some qty was short and due to tht reason again my salary is on hold... today afternoon I recieved a from operations manager and said that u don't need to come to store... over phone.. now pls advice how shoukd I react...
