Hi,

I am working as an IT Coordinator in an MNC. My employer says he will not issue Form 16 as tax is not deducted from my salary. However, I have received Form 16 from my previous organization when my salary was less. As far as I know, Form 16 will be given whether you are taxable or not.

Could you please confirm the procedure?

Dear Sudha,

It is mandatory to issue the Form 16 whether the salary is less or maximum and tax is deducted or not. No employer should refuse to issue this. For further clarification, you can contact the Income Tax helpline in Gurgaon at 0124-2438000.
