Dear All,
1) Please let me know, what component we need to take while fulfilling the criteria of Minimum Wages?
Whether Minimum Wages = Basic Wages + Special Allowance + 5% HRA
Or
Minimum Wages = Basic Wages + Special Allowance
2) If Company has its own Appretice/Training Program of 3 year and it want to give 75% of Minimum Wages as Stipend/Training Allowance then What component we need to consider:
Whether 75% of Minimum Wages = Basic Wages + Special Allowance + 5% HRA
Or
75% of Minimum Wages = Basic Wages + Special Allowance

I do not have a soft copy of the said jusdgment, but I can mail a hard copy to whatever address you provide. Akternatively just check up with company advocate and he will be able to give you a hrad copy anyway!

Minimum Wages Includes the Minimum Wages declaired by the govt + Special allowance declaired by govt. + HRA 5% if the act is applicable (it is a special act in Maharashtra), You cannot bifurgate the above amount in various Allowances but you can give it over and above of the same.
The Minimum Baisc and Special Allowance will attract the statutory deduction like PF, ESIC, PT as well
