Hi, I had been working in Dubai for one of the companies. Recently, I have been terminated by the company. I had worked from July 23, 2008, to January 6, 2009, i.e., 5 months and 12 days. My probation was for six months. Now, my concern is, I want to know whether I will get a salary as long as I stay here in Dubai or only until January 6, 2009. Will I get a return ticket from my company? Your comments will be appreciated. Thanks.

Dear Rehman,

The salary settlement after termination depends upon your agreement, which you might have signed before resuming the duties. Usually, it will be one month's salary if terminated with prior notice after the end of the mentioned period, or if terminated with immediate effect, one month's salary in lieu. Hence, it all depends upon the agreement as I told you. Please refer to the same.

Hi Rehman,

As per the UAE law, if an employee is terminated during the notice period, which can be a maximum of 6 months, then an employer is not obliged to pay any settlements, including end of service benefits, tickets, or leave salary. In fact, during probation, termination can be done immediately without a notice period. That is why they cleverly terminated you before the completion of your probation.

So, all you need to do is go back as you would have received a six-month labor ban or come back and get a new job. You can get the ban lifted by paying AED 5000.
