Discharge refers to the termination of service due to any reason, including retrenchment after following the provisions of the Industrial Disputes Act. An employee may be discharged from service for misconduct after undergoing disciplinary action. However, a discharged employee shall be eligible for unpaid benefits from the company.
On the other hand, dismissal is made for such gross negligence that the gravity of the offense is beyond tolerance. An employee who is dismissed will not be paid gratuity and any unavailed benefits. In the case where dismissal occurs after the employee has been convicted of murder, the PF balance shall also be suspended.
