I would like to know about the number of sick leave, casual leave, and earned leave an employee is eligible for as per the establishment rules. Additionally, I am interested in understanding the calculation process and the eligibility criteria.

Dear Rajshri,

Much of leave is dependent on the culture you wish to establish in your organization. Don't only go by the rule. The rule is in place only to ensure a bare minimum standard. However, we need, in our function, to design creative, individual policies which make sense for the businesses and people we represent. The rule is: 1 day of paid leave (on a pro-rata basis) for every month and a provision of 1 day medical leave and 1 day casual leave, totaling 36 days (12 + 12 + 12). Please read books also.

Many companies these days have earned or paid leave. The concept of sick leave and casual leave has slowly diminished.

The earned leave days can be decided by the managing authority. Ideally, 21 days, 24 days, etc., are what most companies work on. You can decide your leave requirement as per your company's policy.

The quantum of leave depends on many factors, such as whether it is a factory or an establishment. If it is an establishment, the location plays a crucial role as every state has its Shop and Establishment Act, which varies from state to state.

According to the Factories Act, earned leave is accrued at the rate of one day for every twenty days worked. Additionally, casual and sick leave entitlements are determined by certified standing orders, typically consisting of 10 sick leave days and 7 casual leave days.

The government has established laws stipulating a minimum leave entitlement that must be provided, but beyond this, employers have the flexibility to offer additional leave as they see fit.

Hi Malik,

You mentioned about the Factories Act rule of 1 leave for every 20 days, which comes to around 19 days of leave per year. So, are the 10 sick leaves and 7 casual leaves (as per standing orders) included in those leaves?

Hi Malik,

Your question is about CL/SL/EL. Regarding this, I want to say that all leaves basically depend on company to company because every company has its own policies regarding leaves. However, most companies provide a total of 30 leaves:

- 7 CL
- 5 SL
- 18 EL

Dear Rajshri ji,

There is no specific number of leaves for Sick and Casual leaves, but Earned Leaves as per the Factories Act concern for adult workers. If he works 20 days continuously, he will be eligible for 1 day of EL. However, according to the Shops & Estb Act, it is specifically given state to state. Regarding the leave rules I posted earlier on the site, please go through.

In a company governed by the Shops & Establishment Act, are there any restrictions on the number of casual leave days that can be availed? For a company that offers 9 days of casual leave, can an employee take 3 consecutive days of CL or are there specific rules limiting this?

In our company at Hazira, Surat, the management has changed the HR leave policy. Now, they state that SL (sick leave) is at the discretion of the management. Additionally, in our HR portal, only CL/PL (casual leave/paid leave) is displayed, and SL is not visible.

Queries Regarding Leave Policy

My queries are as follows:

1. Our immediate supervisor mentioned that he will not approve my SL as he believes it impacts the promotion cycle.
2. The medical certificate from an external doctor that we provide is considered valid by anyone. Therefore, before submitting it and encountering any issues, it is advisable to have it authenticated by our Occupational Health Centre doctors and obtain the certificate from them.

Please provide updates on the above queries.
