Hi, I am Venhadesh, working in the manufacturing sector. As per our management's decision, I should only allocate 2 days of leave. I am a little confused because Mr. Malik mentioned that paid leave should be at a ratio of 1 day for every 20 worked, which amounts to approximately 15 days per year. Currently, I have only 9 days remaining. How should I allocate these for sick leave (SL) and casual leave (CL)?

I am unsure if I need to make any changes. Could you please clarify this doubt for me? Your prompt response would be greatly appreciated.

Dear Venhadesh.R,

You are advised to go through Chapter VIII of The Factories Act, 1948 for the grant of leave with wages and for the grant of Casual and Sick leaves, you may refer to your State Industrial Establishment (National, Festival, Casual, and Sick Leaves) Act.

Your question is not clear, but I will attempt to answer it. According to the Factories Act, you are eligible to receive one day of leave for every 20 days worked in the previous year. There are no separate Sick Leave (SL) or Casual Leave (CL) entitlements; instead, there is only the provision of annual leave with wages, also known as Earned Leave or Privilege Leave. The leave entitlement under the Factories Act combines the characteristics of both Earned leave (as it can be encashed if not availed) and Casual Leave (as the holidays between two leaves are not counted as leave). Therefore, there is no distinction made between CL and SL under this Act.

Nevertheless, there is no restriction on providing better leave benefits to employees.
