Respected sirs,

Could you please help me with regard to PF? We have started a small company which currently has 25 employees. We have labor registration, SSI certificate, and VAT Certificate. Our employees are now requesting PF deductions, but we do not have PF registration. My queries are as follows:

1. We have not applied for a factory license. If I want to get PF Registration, is it compulsory to apply for a factory license?
2. Can we obtain a PF Code without obtaining a factory license?
3. We have plants in two different locations. Is it possible to have a single PF Code for both locations, or do we need separate codes for each location?
4. Is it necessary to have a pollution control board certificate for PF registration?

Please advise accordingly.

It has been quite some time since I handled registration. However, whatever little I know, I am sharing.

1. We have not applied for a factory license. So, if we want to get a PF registration, is it compulsory to apply for a factory license?

Yes, you need to get your factory/factories registered under the Factories Act. However, you can submit the application stating that you have submitted an application for registration.

2. Without getting a factory license, is it possible to get a PF Code?

Yes, it is possible to get a code without registering under the Factories Act.

3. We have a plant in two different locations. Is it possible to get a single PF Code for two locations, or do we have to get a separate code for each location?

It is possible to get a single code for two locations. In fact, they provide it that way.

4. Is it necessary to obtain a pollution control board certificate for PF registration?

I am not entirely sure about this. Pollution Control Certificates are usually required for awareness rather than as a prerequisite. They may ask for it, but they will still release the code.

Dear Kumar,

It is compulsory to obtain PF registration if employing more than 20 employees. For that, you have to apply firstly for a Factory License. Without obtaining the factory license, it is not possible to get PF registration.

Meanwhile, you can do one thing: take the registration code of your sister concern and deposit the amount of PF in the SBI account using their code. This is the only solution in this situation.

Dear Kumar,

I forgot to answer the last question. For getting registration for PF, you do not need clearance from the Pollution Board because this comes into action while obtaining the Factory License.

Dear All,

I have a small doubt regarding the PF. For a company to be covered under PF, a minimum of 20 employees is required. My question is: Should Directors and Managing Directors also be considered in the count of 20 employees? Should they be counted or not?

Please help me out.
