Hi!

I would like to request all members and seniors to provide some insight on the minimum age of a candidate to be employable in any organization. Have there been any changes in the law recently? Also, please let me know which portion of the Labour Law to check for this.

Minimum Age for employment in a factory is 15 years according to Factories Act. Regards, Nilendra

Hi friends, I know we will get lot more different views about the same. I think it is not 18 years and it is around 15 years. Does any one of you give the right answer for this. Regards Amith R.

In fact, to put it precisely, according to the Factories Act:

A child is a person whose maximum age is 15 years, but more than 14 years. An adolescent is a person whose age is between 15 to 18 years. An adult is a person whose age is more than 18 years. All three categories are employable according to the Factories Act.

Dear,

As I think, as per the section mentioned below, you can find which age is suitable under the Labour Act 1992. In terms of section 42(b) of the Labour Act 1992 (Act 6 of 1992), do not employ any person under the age of 16 years.

Dear Bhavik,

Could you please send the soft copy of the Labour Act 1992? I am requesting this because I am not finding any information about this act on the internet.

What you have written is in direct contravention of the provisions of the Factories Act, which regulates the conditions of service for children and young persons.

You will have to also see the Child Labour prohibition Act.

ii)“child“ means a person who has not completed his fourteenth year of age;

3. Prohibition of employment of children in certain occupations and processes – No child shall be employed or permitted to work in any of the occupations set forth in Part A of the Schedule or in any workshop wherein any of the processes set forth in Part B of the Schedule is carried on :

Provided that nothing in this section shall apply to any workshop wherein any process is carried on by the occupier with the aid of his family or to any school established by or receiving assistance or recognition from, Government

In simple terms it prohibits the employment of children below the age of 14 in factories, mines and in other forms of hazardous employment, and regulates the working conditions of children in other employment.

The Factories Act and other Labour Acts have to read along with this.
