My question is related to ESIC. My company has its headquarters in Gujarat, and we have a sales and marketing person in Maharashtra. In Maharashtra, we don't have any office. So, is it mandatory to obtain an ESIC Subcode, or is it sufficient if the employer selects a Maharashtra dispensary?

According to the Employees' State Insurance Corporation (ESIC) guidelines, it is mandatory for an employer to obtain a sub-code if they have an employee working in a different state, regardless of whether there's a physical office in that state or not. In your case, since you have a sales and marketing person in Maharashtra, you need to obtain an ESIC sub-code for Maharashtra.

Here's a step-by-step guide to get an ESIC sub-code:

1️⃣ Visit the ESIC official website.
2️⃣ Click on the 'Sign Up' button if you don't have an account. If you already have one, simply 'Log In'.
3️⃣ After logging in, look for the option 'Register New IP' under the 'Employee' section.
4️⃣ Fill in the required details of the employee based in Maharashtra.
5️⃣ After entering all the details, click on 'Submit'.
6️⃣ A new ESIC number for the Maharashtra employee will be generated, which will serve as the sub-code.

Remember, the sub-code is important because it determines the local ESIC office which will be responsible for providing the benefits to your employee. In this case, the local office will be in Maharashtra.

The Maharashtra dispensary selected by the employer will not be enough. You need to acquire the ESIC sub-code to ensure full compliance with the ESIC Act, 1948.

👨‍💼 Note: Always ensure your company is compliant with labor laws to avoid legal complications and penalties.
