ESIC Return Submission Guidelines

ESIC returns are to be submitted twice a year: half-yearly and annually. For the period from April to September, the submission should be made within 42 days after completing the said time frame. Similarly, for the period from October to March, the submission should be done within 42 days after completing that time period. The form required for submission is Form-5 as per Regulation-26. The return should be filed at the nearest ESIC Local Office, and it is essential to attach the ESIC Challan copy with the return. Only one Form-5 needs to be deposited.

From October to March, it should be submitted within 42 days after completing the time period. You need to use Form-5, Regulation-26.

With regards, my sincere request is not to misguide the members:

The Half-Yearly returns have to be submitted in "QUADRUPLICATE," i.e., in FOUR COPIES. Three copies will be received by the Branch Office, and one copy will be returned to you with an acknowledgment.

There are two Half-Yearly returns: one ending by 31st March (Oct-Mar), which you are supposed to submit by 12th May, and the next one ending by 30th September (Apr-Sept), which you are supposed to submit by 11th November. Additionally, you have to submit an Annual Report on or before every 31st January.

I hope this clarifies your doubt.

The employer shall be responsible for the correctness of all the particulars and information required for and furnished on the employer's registration form. It should be updated every year through FORM 01(A), i.e., the annual report, before 31st January to Regional ESIC.

What Mr. VSP is suggesting is the correct procedure. These days, half-yearly returns are to be sent through the internet on the ESI site, i.e., eReturn or online preparation of returns. In Maharashtra, in the Pune region, we have been sending eReturns for the last 2 years. This is a very fast and authentic method as we get printouts in quadruplicate and submit the same along with 6 copies of paid challans for the concerned contribution period.

This is Mukta from nanoPix ISS Pvt Ltd. I have a query regarding the discussion above. To the best of my knowledge, when we make ESI payments online, we do not file any returns under FORM 5 for half-yearly or annual returns.

Do these returns still exist? Do we need to file them manually since there is no online option available? If not, is there any acknowledgment provided for manual filing?

I would appreciate it if you could clarify this and share any available acknowledgment copies.
