Hi, I have to work with the company named 'A' where my date of joining matches the last company's exit date. Even though company 'A' submitted the Joint Declaration form, after 3 months, company 'A' came back and said my compensation was submitted for that one day, so they can't change the joining date now. They asked me to contact the last company, but the last company refused to update the exit date.

Please suggest something.

Company A is not in a position to help as it has paid you from the date of joining. It is correct. Did you get a salary for the exit day from the previous company? They can change the exit date, and you need to pursue it with them.

Since the overlap is known to Company A, it may not create a problem for your present employment, but in case you change companies, there could be some issues.

Yes, I received the salary from my previous company as well. My current company assured me they would change the date of joining and submitted the joint declaration form. However, after 3 months, they are now asking me to contact my previous employer.

Yes, that's why I needed it to be changed. Company 'A' shared the company-attested copy of the JDF and other documents with me. I don't know if they did the same with EPFO or not, but now, after 3 months, they are saying it can't be changed. They have advised me to contact my previous employer.

Employer Responsibility for Date of Joining

It is the responsibility of the current employer to change the date of joining. Having the same date for exit and joining is not problematic where shift work is involved. The closing hour of the day coincides with the end of the shift. For example, if a person's last working day is "X" and their shift ends at 12 noon, they can join a new company on the same day, either in the second or third shift, because the employer pays for 8 hours (a shift) but not for the entire day. You can file a case in court to issue a directive to your employer and the EPFO for the correction of the date.
