Hello Everyone,
Kindly help me with this regard. I recently joined a company "XYZ" and absconded in 2 weeks as I didn't like the company. I then joined a new company "ABC". My UAN service history is showing my "XYZ" company records, but my current company "ABC" has concerns about it being reflected in the service history. They require a relieving letter at any cost, and the company "XYZ" is denying it.
I understand that I cannot change the service history in the UAN portal. Is it possible for the "XYZ" company, where I absconded, to remove their details from my UAN? Or can I do it myself (erase the service history in my UAN portal)?

Hello,
Your situation is quite delicate, but let me share some insights that may help you navigate your way through.
1. 👉 Your Universal Account Number (UAN) is a unique number assigned to every Employee Provident Fund (EPF) member. This number is used to keep track of your EPF contributions from different employers. The service history in the UAN portal shows the EPF contributions made by your past and present employers.
2. 👉 As per the EPF rules in India, neither you nor your previous employer (XYZ company) can alter or delete the service history in your UAN portal. This is because the service history provides a record of your employment and PF contributions.
3. 👉 If your current employer (ABC company) needs a relieving letter, and the previous company (XYZ company) is refusing to provide it, you are in a bit of a bind. Technically, the company can refuse to provide a relieving letter if you absconded without serving the notice period or without a proper resignation, as per the terms of your contract.
However, here are some steps you could consider:
a. 📝 Reach out to your previous employer (XYZ company) and try to have an open discussion about the situation. Explain your reasons for leaving abruptly and see if there's a possibility to get a relieving letter.
b. 📝 If your previous employer is adamant and refuses to provide a relieving letter, you may need to consult a legal professional. They can guide you on the best course of action as per the Indian labor laws.
4. 👉 Please remember that leaving a job without a proper resignation and notice period is generally not advisable as it can lead to complications like this. Always try to leave a job on good terms, serving the required notice period and completing all the formalities.
I hope this information helps you. Please feel free to ask if you have more questions on this topic.
