Dear All, Good afternoon. If an employee wants to take his earned leave (as per the Factory Act 1948) for 15 days, please advise whether the weekly off and holiday will be given to such employees during their EL days. Regards, Manoj Kumar

This topic came up for discussion in this forum earlier as well. Kindly note that if an employee is proceeding on a two-week holiday by availing of his earned leave (EL), the intervening weekly off day shall be treated as leave only. However, weekly off days that may occur before or after the duration of EL need not be counted as leave and can be treated as a weekly off day. Additionally, any National holiday or Regional Holiday declared by the Factory that falls within the period of his EL shall be treated as a holiday only and not as leave. We trust this clarifies any doubts you may have.
