Sir,
One person has worked in a Govt. banking Sector till his retirement age of 60 years where is he got Rs.300000/ for Gratuity amount .Now after retirement he joined our public limited company as a DGM-Banking with regular appointment letter(fixed term) for two years , whereas he worked for more than 5 years with extended service in three times and now he resigned at the age of 67 yrs. .
There is no standing order passed by any authority ,as per our recruiting policy, Normal retirement age is 58 years and as per our Gratuity trust account opened age limit is also 58 years .Now please let me know whether this person is eligible to get Gratuity amount from our company ?? If yes then how much??

Sir,
Our some senior employees are retired and received their of Full & Final settlement from the company and they are getting pension from EPF. Now we have re-appoint them on regular employment on fixed term basis and extended their re-appointment time to time. Please advise us are they eligible for EPF and Gratuity or not.

So far as EPF is concern as the employee is receiving Pension from EPFO, therefore the employee is excluded employee. So not covered under PF.

IF the continuous employment by extension is 5 years or more will be eligible for Gratuity.
